Reporting Issues of Copyright Infringement: Notice of Infringement (Takedown Notice)

 

Crochetville respects the copyright, trademark, and intellectual property rights of others, and we expect all of our members to do the same with all aspects of the Crochetville service (posts, private messages, and email to other members). When necessary and at its discretion, Crochetville may deactivate and/or terminate the accounts of users who we believe are infringing upon the intellectual property rights of other parties.

 

If you believe that your work has been copied in a way that constitutes copyright infringement, or any of your intellectual property rights have been otherwise violated, please submit a Notice of Infringement containing all of the following information to Crochetville's Copyright Agent through any of the contact methods listed above:

  • Identify the work that you claim has been infringed
  • Provide a link to the material's location on Crochetville
  • Your name, address, telephone number, and email address
  • A statement that you have a good-faith believe that the disputed use is not authorized by law
  • A statement, made under penalty of perjury, that the information you are submitting is accurate and that you are the owner of the copyrighted material or are authorized to act on behalf of the copyright owner
  • Your digital or physical signature

Upon receipt of this information, we will do our best to remove the offending material as quickly as possible. We will also forward the Notice of Infringement to the alleged infringing party, who has the right to respond with a Notice of Non-Infringement.

 

You acknowledge that your DMCA Notice of Infringement may not be valid if you fail to comply with all of the requirements listed above.

 

If you are not the intellectual property owner: Please contact the intellectual property owner, give them a link to the potentially infringing material, and a link to this thread so they can make a direct report to us, enabling us to take action.

 

Replying to Issues of Copyright Infringement: Notice of Non-Infringement

 

If you believe that the material you posted is not infringing, or that you have the right pursuant to the law to post that content on Crochetville, you may send a Notice of Non-Infringement containing all of the following information to Crochetville's Copyright Agent through any of the contact methods listed above:

 

  • Identification of the content that has been removed or to which access has been disabled and (if possible) the URL or the location at which the content appeared before it was removed or disabled
  • Your name, address, telephone number, and email address
  • A statement that you have a good-faith believe that the disputed use is not infringing upon the copyright or other intellectual property rights of any other party
  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content
  • A statement, made under penalty of perjury, that the information you are submitting is accurate and that you are the owner of the copyrighted material or are authorized to act on behalf of the copyright owner
  • A statement that you consent to the jurisdiction of the federal court for your state of residence, and a statement that you will accept service of process from the party who provided notification of the alleged infringement
  • Your digital or physical signature

Upon receipt of a Notice of Non-Infringement by the Copyright Agent, Crochetville will send a copy of such notice to the original party, along with a statement that the allegedly infringing content may be replaced within 10-14 business days, unless Crochetville's Copyright Agent receives notice that the original party has filed a copyright infringement lawsuit against the poster of the allegedly infringing content.

 

If Crochetville receives notice that a copyright infringement lawsuit has been filed, Crochetville will await resolution of the lawsuit before making a decision as to whether to return the content to the Crochetville site.
